        Understanding Your Charges

Having a suspended license means that you do not get to go on errands or meet up with friends or pick up your kids from school. If you drive with a suspended license or a revoked license, the penalties can be very severe.

At maximum, your fine can be $2500 and a year in jail as well as any of the costs needed to get your driver’s license back. You may also have your vehicle impounded.

We may be able to create a defense if you did not know yet that your license had been suspended when you got pulled over. And we might be able to get you some of your driving privileges back in order for you to keep your job for example.

Virginia law considers driving with a suspended or a revoked license as a serious misdemeanor charge and as stated can end up with you in jail or paying a big fine before you can be able to drive again. You will have a criminal record if you’ve been convicted and it’s not as simple as being able to pay a small fine and being able to forget about it 10 years from now.

We want you to know that you have options and that when you speak to our Virginia driving with a suspended license lawyers we can help you protect your rights. We will look into whether or not you had proper notice of your suspension or if the police officer had a valid reason to pull you over that day, as well as any other defenses that might be available to us for you to be able to get your license back and avoid the serious consequences.

Why You May Have a Suspended License

Having a suspended license means you will not be allowed to drive a vehicle in Virginia. It doesn’t matter why— you simply cannot be doing it. Once the period of your suspension has lapsed, then you can go through the DMV to get your license back. You do have to meet all of their requirements for being reinstated as a driver’s license holder and pay the fee necessary and sometimes that means you have to go to a class or an interview. Here are the following reasons why you may have had your license suspended in the first place in Virginia:

        • You did not pay fines to the court for a ticket you got in the past
        • You were convicted of reckless driving
        • You received too many points on your driver’s license for traffic violation convictions
        • You were not up-to-date on child support or fees for jail
        • You did not have proper insurance for your vehicle

You have a health condition that prevents you from safely operating a motor vehicle

Why You May Have a Revoked License

When your license is revoked, you’re banned from driving in Virginia altogether. You also can have driving privileges reinstated when your license is revoked once you’ve complied with the terms, but you have to re-take the driver’s test and get an entirely new license.

Revocation happens under more serious circumstances than a suspension, such as:

        • A conviction for driving while intoxicated or under the influence of drugs or alcohol
        • Getting caught driving while your license is suspended because of a DUI
        • Being convicted of voluntary or involuntary vehicular manslaughter
        • Falsifying information when applying for a driver’s license, or taking someone else’s driving test or renewing someone else’s license for them
        • Drug convictions even when driving wasn’t involved
        • Committing a felony using a motor vehicle
        • Driving away from the scene of a crash without stopping to provide your information
        • Too many points on your license because of convictions while younger than 18

Penalties For Driving with a Suspended License

If you end up with a conviction for driving with a suspended license you could be facing the following:

        • Jail time
        • Heavy fees
        • And impounded vehicle
        • Losing any future driving privileges

If it is your first offense of this misdemeanor in Virginia, you could face up to one year in jail as well as a $2500 fine and any of the costs to reinstate your license or get your vehicle back after it’s been impounded.

If this is your third offense within 10 years of your prior convictions of driving with a suspended or revoked license, you will receive another suspension as well as the prior mentioned penalties and if you are caught within 90 days of this suspension you will no longer have driving privileges for another 90 days.

        How We Defend Your Charges

In order for the prosecution to convict you, they have to prove the following:

        • Your license was indeed suspended
        • You were physically operating a motor vehicle
        • You had prior knowledge that your license was suspended

In Virginia a motor vehicle means more than just a car. Anything that is “self-propelled“ and is on a street or a highway can be considered a motor vehicle. That would include a moped or a motorcycle, a car or a truck.

According to the law in Virginia, you need to be notified if you have a suspended license and if you didn’t know then we can use that as a defense moving forward. We can challenge your charge by stating that you had no knowledge of your license suspended therefore you shouldn’t face the penalties of this charge.

If the police did not have a valid reason to pull you over then we can fight this to get your charges dropped for your charge of driving with a suspended license. They must be able to show that they had a valid reason to pull you over; otherwise, it’s not a lawful stop and you can’t be penalized for it.

        Getting Your Driving Privileges Back

Sometimes the easiest way to get your license back is to go through the necessary steps. If you do a good job of paying back your fines and you meet the requirements in order to get your license back, the judge may be able to do so. You do have a better chance when you have Virginia driving with a suspended license lawyers by your side to help you through this. Your charges could be dismissed when you have the right help.

It will depend on the circumstances surrounding why your license was revoked or suspended on whether or not you’d be able to get your license back. You will likely pay the DMV in Virginia to do so. If you have a suspended license because you were delinquent on fines then that will need to be repaid in order for you to have your license reinstated. Furthermore, if you didn’t have proof of insurance you will need to get that before you can have your license back.

        Options for a Restricted License

When you have a suspended or revoked license, it doesn’t necessarily mean that you could never drive. You might be able to apply for a restricted license during this time where your privileges have been limited. This will depend on the circumstances of your charges which our Virginia driving with a suspended license lawyers can help you understand better. You will likely have to show the court a good reason why you need permission to have a restricted license and you will pay the DMV.

If you need driving privileges in order to keep your job and provide for yourself for your family, you might need a letter from your employer stating that having a vehicle and the ability to drive one is important to being able to maintain your employment with them. If you do drive outside of the parameters of your restricted license you are looking at being charged with driving with a suspended or revoked license.
